If the respondent intends to oppose the application for judicial review, it must file a notice of appearance using Form 305 within 10 days after being served with the notice of application.
What if the Respondent Fails to File a Notice of Appearance?
If the respondent does not file a notice of appearance, this does not mean that the matter is over. Instead, the matter will proceed ahead, but no further documents in the proceeding need be served on the respondent prior to the final judgment, unless the Court orders otherwise.
